Agreement to Terms

Welcome to BibahoBangla. These Terms and Conditions ("Terms") govern your access to and use of our matrimony platform, including our website (bibahobangla.com) and mobile applications (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.

Eligibility

To use BibahoBangla, you must:

• Be at least 18 years of age or the legal age of marriage in your jurisdiction
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Services under applicable laws
• Not have been previously banned or removed from our platform
• Provide accurate and truthful information
• Use the Services for lawful matrimonial purposes only

Account Registration

Creating an Account

To access certain features, you must create an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

Account Security

You are responsible for maintaining the confidentiality of your account credentials. BibahoBangla will not be liable for any loss or damage arising from your failure to protect your account information.

One Account Per User

Each user is permitted to create only one account. Creating multiple accounts may result in suspension or termination of all your accounts.

Prohibited Activities

You agree NOT to:

• Provide false, misleading, or fraudulent information
• Impersonate any person or entity
• Use the Services for commercial or business purposes
• Promote or facilitate companionship, dating, or any services in exchange for compensation or payment
• Harass, abuse, or harm other users
• Send spam, solicitations, or promotional content
• Collect or harvest user data without permission
• Use automated systems (bots, scrapers) to access the Services
• Attempt to bypass security measures or access restrictions
• Upload viruses, malware, or harmful code
• Infringe intellectual property rights
• Post inappropriate, offensive, or illegal content including sexually explicit material
• Use the Services for fraudulent matrimonial purposes
• Engage in any activity that violates applicable laws

User Content

Content You Post

You are solely responsible for the content you upload, including photos, text, and profile information ("User Content"). You represent and warrant that:

• You own or have the right to use all User Content
• Your User Content does not violate any laws or rights of third parties
• Your User Content is truthful and not misleading
• Your photos are current and accurately represent you

License to User Content

By posting User Content, you grant BibahoBangla a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and display your content for the purpose of providing and promoting our Services.

Content Moderation

We reserve the right to review, monitor, and remove any User Content that violates these Terms or is deemed inappropriate, at our sole discretion, without prior notice. Every photo and video is screened automatically before it is accepted (a face must be present; nudity, offensive content and pictures that are mostly text are rejected), and our staff may review any content.

Community Safety: Zero Tolerance

BibahoBangla has no tolerance for objectionable content or abusive members. This includes sexually explicit or suggestive material, harassment, threats, hate speech, impersonation, scams and any attempt to solicit money or offline "companionship".

• Report: every profile has a Report button. We review reports and act on them within 24 hours by removing the content and, where warranted, ejecting the member.
• Block: you can block any member at any time; blocked members can no longer see or contact you. Your block list is under Settings.
• Verification: every account is registered with a mobile number confirmed by SMS, and members can complete an optional face verification to earn a verified badge.

Members who violate this section are removed from the platform without refund.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy, which is incorporated into these Terms.

By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.

Payments, Packages and Refunds

Creating a profile, searching, sending interest and receiving messages are free. Some contact features use a wallet balance or a package:

• Prices are shown in Bangladeshi Taka (BDT) and may change; the price shown at the time of purchase applies.
• Payment is processed by bKash. You enter your bKash details on bKash's own secure pages. On the iOS app, purchases are made on our website with the same account.
• Digital service: wallet balance and packages are digital services that start immediately after payment, are personal to your account and cannot be transferred to another member.
• Refunds: if a payment was charged but not credited to your wallet or package within 24 hours, contact support with the bKash transaction id within 7 days and we will credit it or refund it to the same bKash account. Balance that has already been used, contacts that have already been unlocked, and the unused part of a package are not refundable.
• Deleting your account or being removed for violating these Terms forfeits any remaining balance or package without refund.

Termination

Termination by You

You may terminate your account at any time by:

• Deleting your account in the app: Settings > Delete Account, confirmed with your password. Your account and personal data are deleted immediately, as described in our Data Deletion Policy.

Termination by Us

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms or our policies
• We suspect fraudulent, abusive, or illegal activity
• You engage in conduct that harms other users
• We are required to do so by law
• We discontinue the Services

Effect of Termination

Upon termination:

• Your right to access the Services immediately ceases
• Your profile will be removed from public view
• We may delete your account and User Content
• No refunds will be provided for unused membership periods

Disclaimers

• Conduct background checks. Mobile confirmation and the optional face verification only confirm that a live person matches the profile photo; they do not verify a member's identity, marital status, background or intentions
• Guarantee the accuracy of user-provided information
• Endorse or vouch for any user or profile
• Guarantee that you will find a suitable match
• Make any promises regarding marriage outcomes

Service Availability

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee that:

• The Services will be uninterrupted or error-free
• Defects will be corrected
• The Services are free from viruses or harmful components
• Results obtained from the Services will be accurate or reliable

Limitation of Liability

To the maximum extent permitted by law, BibahoBangla and its officers, directors, employees, and agents shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or availability issues
• Actions or conduct of users or third parties
• Unauthorized access to your data or communications
• Content or statements made by users

Our total liability to you for any claims arising from your use of the Services shall not exceed the amount you paid to us in the past 12 months, or BDT 1,000, whichever is greater.

Your Responsibility

You acknowledge and agree that:

• You are responsible for your interactions with other users
• You should exercise caution and common sense when meeting people
• You should verify information before taking any action
• You should follow our Safety Tips
• BibahoBangla is not responsible for your offline interactions
• You release BibahoBangla from claims related to user conduct

Intellectual Property

Our Content

All content on BibahoBangla, including text, graphics, logos, icons, images, software, and design, is the property of BibahoBangla or its licensors and is protected by copyright and intellectual property laws.

Your Use

You may not:

• Copy, modify, or distribute our content
• Use our trademarks or branding without permission
• Reverse engineer or decompile our software
• Create derivative works from our Services

Indemnification

You agree to indemnify, defend, and hold harmless BibahoBangla and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Services
• Your violation of these Terms
• Your violation of any rights of third parties
• Your User Content

Dispute Resolution

Governing Law

These Terms are governed by the laws of Bangladesh, without regard to conflict of law principles.

Jurisdiction

Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in Dhaka, Bangladesh.

Informal Resolution

Before filing a claim, you agree to try to resolve disputes informally by contacting us at support@bibahobangla.com.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Posting the updated Terms on our website
• Sending an email notification to registered users
• Displaying a notice on our app

Your continued use of the Services after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Services.

Third-Party Links

Our Services may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party sites. Use of third-party services is at your own risk.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and BibahoBangla regarding the use of our Services.
